3. Learned counsel for the petitioner submits that aforesaid sessions trial is pending before the Upper Sessions Judge, FTC, Korba, against respondents No. 1 to 4/accused persons. After framing of charge, 12 witnesses have been examined by prosecution, but so many eye-witnesses namely Mantori Devangan, Smt. Rambai alias Tumnahin, Smt. Sahodara Bai Kanwar, Santosh Kumar Sahu and Prem Bareth have also seen the incident, which they have also stated in their statements recorded by the police under Section 161 of the Cr.P.C., but aforesaid eye-witnesses have not been listed by the Public Prosecutor in the list of eye-witnesses given by him in the Court. Since petitioner himself is a victim, therefore, he filed application under Section 311 of the Cr.P.C. for calling those witnesses and to record their statement, but the same was partly allowed by learned trial Court vide impugned order and only Ganesh Ram Dewangan has been directed to be summoned for recording his statement, therefore, it is prayed that, this petition along with application filed by the petitioner under section 311 of the Cr.P.C. (Annexure P-3) may be allowed and aforesaid witnesses mentioned in Annexure P-3 may be directed to be called for recording their statement before concerned Upper Sessions Judge.
