The petitioner has filed the instant petition seeking the following relief:-

“It is prayed that the Hon’ble High Court may

kindly be pleased to allow this petition and

quash the order dated 17/01/2019 passed by the learned Special Judge (P.C. Act) and 4^th A.S.J, Raipur be pleased to direct the trial court to defer the hearing in the instant Trial till completion of reinvestigation by the S.I.T. in the interest of Justice.

Learned Counsel for the petitioner states that the petition may be permitted to withdraw the petition.

On the other hand learned counsel for the State submits that the trial is in progress and the case is fixed for defense evidence.

We are not inclined to interfere in the matter. Accordingly, the prayer for withdrawal is rejected and Cr.M.P. is also rejected.
