submit that he has filed a Civil Suit for permanent injunction against the present petitioners before the Court of learned Second Civil Judge Class-1, Mungeli vide Civil suit No.46-A/2015, in which the present petitioners have filed their counter claim for permanent injunction against the present respondent No.2 and by its judgment and decree dated 12.03.2019 in the said civil suit, the claim of the present petitioners have been denied and held that the present petitioners are not in possession of the land in dispute. It has been settled by the judgment and decree passed by the learned trial Court that the present petitioners are not in possession of the land in question. He would further submit that earlier also when the present petitioners have committed theft of crop of the respondent No.2, he moved an application under Section 156(3) of Cr.P.C. for registration of the FIR against them and inquiry into the matter was conducted and the said application was disposed of on the ground that the FIR has already been registered earlier in the year 2014. He would also submit that the against the judgment and decree passed by learned trial Court in the Civil Suit, he has already filed an appeal before the Appellate Court which is pending for consideration.
