that Rajkumar is not in home and he had gone for grazing cattile, then the appellant left, the spot and again came back at about 8.00 a.m. armed with axe, at that time, she (PW-1) was sweeping on the street of her house, the accused asked, where her mother was on which she informed that her mother is inside the house and at that time, her sister Mangli (PW-3) was also cleaning the courtyard and the appellant with intention to kill her mother citing that his brother is unwell, tried to assault her mother by axe then they tried to intervene and her mother went towards the courtyard, the appellant chased her (deceased) and assaulted her by axe on her neck by which she fell down and thereaft,er, the appellant absconded from the spot. She has further stated that the appellant has assaulted her mother (deceased) by axe citing that her mother Budhan Bai used to practice witchcraft,. Though she has been subjected to lengthy cross-examination, but nothing has been extracted from her to hold that she has not seen the incident or she is telling lie.
