house of Harisai after attending the marriage ceremony, the appellant/accused met her on the way and caught hold her and when the complainant/ victim asked him to leave, the appellant/accused threatened to kill her and when the complainant/victim tried to raise alarm, the appellant/accused gagged her mouth by putting cloth inside her mouth and thereafter forcibly taken her towards the agricultural field, where the appellant committed sexual intercourse with her. The appellant/accused kept the complainant/victim in the agricultural field throughout the night and committed repeated sexual intercourse with her and she was freed by the appellant in the morning. After reaching the home, the victim narrated the incident to her parents and thereafter, the matter was brought to the panchayat where no decision was taken place. Therefore, the complainant/victim along with her parents went to the concerned police station and on the basis of written complaint, FIR came to be lodged against accused/appellant. During the course of investigation, after obtaining the permission of Tahsildar and consent of the prosecutrix (PW-01) and her father (PW-02), the prosecutrix was sent for medical examination to District Hospital where she was medically examined by Dr. Smt. S. L. Kujur (PW-05) who gave her report in Ex. P/7 and no definite opinion regarding recent sexual intercourse was given. Thereafter the school transfer certificate of the prosecutrix was seized vide Ex.P/3. The pieces of broken bangles were also seized under Ex.P/4. Spot map was prepared and thereafter the accused/appellant was arrested. After completion of investigation, the appellant was charge-sheeted before the Court of Judicial Magistrate, Ambikapur. However, the case was committed to the Court of Sessions Judge, Surguja (Ambikapur) and the matter was registered as Sessions Trial No.418/2002.
