of the appellant herein (Ex.P-6), wooden stick, clothes of the appellant herein as also clothes of the deceased-Radha Bai were seized and sent for chemical examination and vide FSL report (Ex.P-27), it was opined that the aforesaid articles contained human blood and even in the clothes of the appellant herein, it was opined that the said articles contained “O” blood group. Dead body of the deceasedRadha Bai was subjected to postmortem and postmortem of the dead body of the deceased-Radha Bai was conducted by Dr. A. K. Gour (PW-9) and his report is Ex.P-13 and cause of death was stated to be fracture of skull occipital bone and damage of brain due to head injuries and it was stated to be homicidal in nature. The jurisdictional police carried out the investigation and charge-sheeted the appellant herein under Sections 294, 323, 450 & 302 of IPC before the Court of Judicial Magistrate First Class, Nagri, District Dhamtari, who in turn, committed the case to the Court of Sessions Judge for trial in accordance with law. The appellant herein abjured the guilt and entered into defence by stating that he has not committed the offence and he has been falsely implicated in the offence in question.
