Case of the prosecution, in short, is that on 07.11.2007, at 10:00 p.m., at village Akhorakhurd, Jabakhand, Police Station- Jaynagar, District Surajpur, the appellant herein kidnapped the minor victim from her lawful guardianship and committed forceful sexual intercourse against her wish and thereby the offence has been committed. The victim (PW-1) reported the matter to the police vide Ex.P-1 and thereafter, the victim was subjected to medical examination by Dr. Suchita Nirmla Kindo (PW-5) who gave her report vide Ex.P-7, in which sign & symptom of sexual intercourse was found. The slides of victim were prepared vide Ex.P-6 and sent for chemical examination to the FSL and as per the FSL report (Ex.P-14), stains of human sperm and semen was found. With regard to age of the victim, school admission register was seized vide Ex.P-9. After due investigation, the appellant was charge-sheeted for the aforesaid offences before the jurisdictional criminal court, which was ultimately committed to the Court of Sessions for hearing and disposal in accordance with law, in which the appellant abjured his guilt and entered into defence stating that he has not committed any offence and he has been falsely implicated.
