21. Ghanshyam @ Bunty (PW-1), who is a minor witness, stated in his deposition that he knows the accused Hemlal, who is from his village. He also knew the deceased, who was his uncle. On the date of incident, he was going to Kukri Para to bring his aunt's friend and at the same time, the accused was walking while smoking a cigarette. When he reached near the crematorium in the evening, Hemlal abused him and chased him away. Then, Hemlal stood near the drain. After that, the accused Hemlal hit his uncle two-three times with a hammer, which the witness demonstrated and described as hitting on the head and temple region. Thereafter, the accused put his hand in his uncle's pocket, but he does not know that the accused had taken money or keys. After that, the accused flew away with his uncle's vehicle. Then, he went to her aunt's place, and it was raining at that time. When he was returning home, he saw people crying and coming towards the crematorium and he told her aunt that Hemlal had beaten him. After that, he came home, parked his cycle and went with the others.
