After obtaining necessary consent vide Ex.P/13 & Ex.P/14, the victim (PW-11) was subjected to medical examination, which was conducted by Dr. Samta Rangari (PW-18) and, as per her MLC report Ex.P/28, it has been opined that old ruptured hymen was found, no internal or external injury was found over the body the victim (PW-11) and no definite opinion can be given regarding rape. Further, victim’s vaginal slide was prepared and handed over to the police for analysis alongwith her undergarment, which were seized vide Ex.P/11. The accused-appellant was arrested vide Ex.P/22 and his undergarment was also seized vide Ex.P/01. Thereafter, aforesaid seized articles were sent for chemical examination, as per FSL report (Ex.P/25) it has been opined that no stains of human sperm/semen were found on any of the seized articles. In order to ascertain correct age of the victim, copy of relevant page of Dakhila Kharij Register of the victim (PW-11) [Art./A3 & A] and her school mark-sheet (Art./A1) were obtained/seized, wherein her date of birth has been recorded as 05.07.2002, meaning thereby, the victim (PW-11) was minor aged about less than 18 years on the date of offence. Further, victim’s caste certificate (Art.A/2) was also seized, in which it is mentioned that the victim (PW-01) belongs to Scheduled Caste community.
