The instant contempt petition has been filed by the petitioners alleging non-compliance of an interim order dated 23.01.2023, passed by this Court in W.P.(S) No.732/2023.

This Court by order dated 23.01.2023, directed as under:-

“Considering submissions made by counsel for petitioners, as also pleading made in writ petition, purely as an interim measure, it is directed that effect and operation of order Annexure P-1 dated 16.01.2023, shall remain stayed till the next date of hearing.”

A conjoint reading of the above quoted order along with the material available on record would show that before the order in question could be passed on 23.01.2023, the Chief Medical & Health Officer, Bijapur has already canceled the appointment of the petitioners by order dated 20.01.2023 (Annexure C-3), which was in compliance of the order of Collector, Bijapur dated

16.01.2023. However, the said order dated 16.01.2023 was subject matter of challenge in W.P.(S) No. 732/2023 and it is always open for the petitioners to challenge the order dated 20.01.2023 (Annexure C-3) in the said writ petition, if not already done.

In that view of the matter, no case for contempt is made out. Accordingly, the instant contempt case is closed.
