1. By way of instant contempt petition, the Petitioner has sought for initiating contempt proceedings against the Respondents for the alleged willful disobedience of the order dated 21.06.2021 passed by this Court in WPS No. 2062/2016.

Learned Counsel for the Petitioner submits that he is working under the same post of Child Development Project Officer (CDPO) office at Integrated Child Development Service (ICDS) but the charge of the post is not being assigning to the petitioner by the authority concerned despite several requests.

On perusal of the order it transpires that the Co-ordinate Bench has observed in paragraph 28 that “the impugned order of the Commissioner placing the petitioner under suspension is in accordance with law and is hereby affirmed, however, order changing headquarter from Mainpur to Gariyaband being contrary to law deserves to be and is hereby set aside.” The Coordinate Bench has already decided the said issue and set aside

the order dated 18.05.2016. As such, the grievance of the petitioner has already been redressed.

4. As regards the submission of the petitioner that the charge of the post has not given to him, it is the discretionary power of the Competent Authority who would decide the same. Once the competent authority passes an order as per the direction given by this Court, there is no willful disobedience or willful noncompliance of the order dated 21.06.2021 warranting initiation of contempt proceedings. Hence, the order stands duly complied with.

5. Accordingly, this contempt petition stands dismissed.
