account of his retirement they should have vacated the said house within two months from his retirement and after his retirement on 30.09.2011, they had not paid rent for the period from 01.10.2011 to 31.10.2013. i.e. for 25 months, for which the total amount of rent calculated to be Rs.50,000/-. He also submits that despite all the communication to the petitioners, they are not vacating the said Government building and repeatedly making wrong statements that they have not occupied any government house at Janakpur. The petitioners have constructed their own private house near the said government building, and on the instruction of Divisional Forest Officer, Manendragarh, spot panchanama (Annexure R/2) was prepared in presence of five witnesses, in which it was found that the petitioners are having the possession of the said government building and using the said premises for the purpose of parking their vehicle and keeping their belonging. The house of the petitioners is just beside the government building, which is also shown in the photographs annexed with the spot panchanama. As such, the illegal possession of the petitioners stand proved over the said government building at Janakpur and the petitioners are making fallacious statement that they are not in possession of the said building. It is also submitted by learned State counsel that Nazri Naksha (Annexure R/3) has already been prepared by the Range Assistant Chanti, Forest Range Kunwarpur, wherein it has been shown that the petitioner Umashanker Singh is having the possession over the said government building. Thus, this petition has been filed by the petitioner with melafide intention and the same is liable to be dismissed.
