he be given the said charge of Block Education Officer, Prem Nagar, Surajpur. Further, letter dated 5.12.2022 written by the Petitioner, which is available at page 36 of the writ petition, also shows that even after submission of his application for taking over charge he has not been given the charge by Respondent No.5. The communication dated 20.10.2023 written by the District Education Officer, Surajpur to the Petitioner herein, which is submitted by the Petitioner with covering memo dated 20.11.2023, also shows that in compliance of the order passed by this Court the salary of the Petitioner from the month of April, 2023 onwards is provided by the District Education Officer, Ambikapur, i.e., from the earlier place of posting where the Petitioner was posted. Thus, it is clear that as of now, the Petitioner has not been given official handing over of charge by Respondent No.5 and the Petitioner is receiving his salary from his earlier place of posting, i.e., Ambikapur and this clearly shows that the transfer order dated 30.9.2022 has not duly been executed. Therefore, I do not find any substance in the argument raised by Learned Counsel for the Petitioner that the transfer order of the Petitioner dated 30.9.2022 has already been complied with. Both the cases cited by Learned Counsel for the Petitioner are distinguishable on facts as in both the cases transfer orders have been executed and in the case in hand the transfer order has not been executed.
