The petitioner is an accused facing trial in Sessions Case No.66/2017 (State of Chhattisgarh v. Ravi Kashyap and others) for offences under Sections 147, 148, 149, 341, 447, 294, 506-B, 307 of the IPC and Sections 25 & 27 of the Arms Act pending before the Court of Third Additional Sessions Judge, Bastar, at Jagdalpur.

The petitioner has filed this writ petition seeking direction to the trial Court to expedite the trial pending in the above stated Sessions Case No.66/2017and conclude the same within the stipulated time. In the meanwhile, Basant Singh and others have filed Transfer Petition

(Criminal) Diary No.32724/2019 (Basant Singh & Ors. v. State of Chhattisgarh and Ors.) before the Hon'ble Supreme Court, in which their Lordships have directed by order dated 23.02.2023 as under:-

“8. Accordingly, we direct that Sessions Case No.66/2017 pending in the Sessions Court at Jagdalpur, Chhattisgarh, Criminal Case No.1785 of 2018 arising out of FIR No.109/2017 presently pending in the Court of the learned Chief Judicial Magistrate, Jagdalpur and Criminal Case No.1879 of 2017 arising out of FIR No.121 of 2017 pending in the Court of the learned Judicial Magistrate, First Class, Jagdalpur to appropriate Courts in Delhi as may be decided by Hon'ble the Chief Justice of Delhi High Court.”

Learned counsel for the petitioner would submit that in view of the above stated order, petitioner be permitted to withdraw the instant writ petition to avail the remedy before the appropriate High Court. The said prayer is not opposed by learned State counsel.

Since the Sessions Case No.66/2017 (State of Chhattisgarh v. Ravi Kashyap and others) has been directed to be transferred to the appropriate Courts at Delhi, the instant writ petition is dismissed as withdrawn with the aforesaid liberty reserved in favour of the petitioner. However, it is made clear that this Court has not expressed any opinion on the merits of the case.

With the aforesaid observation / direction the instant writ petition stands disposed off.
