Heard Mr. Awadh Tripathi, learned counsel appearing for the petitioners and Ms. Madhunisha Singh, Deputy A.G. appearing for the State/respondents.

1 . By way of this petition filed under Section 226 of the Constitution of India petitioners have sought for the following reliefs:-

“10.1 That, this Hon’ble Court may kindly be pleased to issue appropriate writ by quashing the impugned inquiry report dated 16.06.2014 (Annexure-P/1) made by the respondent No.2.

10.2 That, this Hon’ble Court may kindly be pleased to direct the respondents to completely set aside the proceeding which has been initiated on the basis of inquiry report dated 16.06.2014 made by the respondent No.2.

10.3 That, any other relief which this Hon’ble Court deems fit and proper may also kindly be granted to the petitioner in the interest of justice along with costs of the petition.

10.4 That the F.I.R. dated 08.05.2014 (Annexure-P/4) may kindly be quashed. ”

2 . Learned counsel appearing for the State submits that in the present case, investigation has been concluded and the charge sheet has been submitted before the concerned Court.

3 . Learned counsel for the petitioners submits that h e may be permitted to withdraw the instant writ petition with liberty to file an appropriate application under Section 482 of Cr.P.C. for quashing of the charge sheet before the competent Court.

4 . In view of the prayer made, the writ petition is dismissed as

withdrawn with liberty to the petitioners to take recourse to

law, if aggrieved by the charge sheet submitted against the

petitioners.
