Heard Mr. Vivek Kumar Shrivastava, Advocate appearing for the petitioners. Also heard Mr. Amrito Das, Advocate, learned counsel appearing for the respondents.
2. The writ petition No. 1163 of 2022 has been filed by the petitioner with the following prayers:
“ 10.1 To call for the records of the case for the kind perusal of this Hon’ble Court.
10.2 To issue an appropriate writ or order and declare that the order dated 23.02.2022 (Annexure P-1) is illegal, bad in law and suffers from colourable exercises of power.
10.3. To issue an appropriate writ or order and set aside the order dated 23.02.2022 (Annexure P-1).
10.4. Any other relief deemed fit in the facts and circumstances of the case may also be granted.”
3. The writ petition No. 1483 of 2022 has been filed by the petitioner with the following prayers:
“ 10.1. A writ and/or an order in the nature of appropriate writ do issue calling for records from the respondents pertaining

to petitioners’ case for its perusal, if deem fit in the facts and circumstances of case.
10.2 A writ and/or an order in the nature of writ of certiorari do issue quashing Notice Inviting tender dated 23.02.2022 (AnnexureP-1) issued by respondent concerned and all subsequent action thereto including the award of work to any other person being illegal, arbitrary and comes within the purview of malice in law and malice in the facts and circumstances of case.
10.3 Cost of the proceedings.
10.4. Any other writs/directions that may be deemed fit and just in the facts & circumstances of case.”
4. Learned counsel for the petitioners would submit that since the fresh NIT has been issued, these petitions have been rendered infructuous.
5 Learned counsel for the respondent does not controvert the above submission.
6. In view of the above, the instant writ petitions are dismissed as having become infructuous.
