Learned counsel for petitioner submits that petitioner has submitted an application under Section 36 (3) of the C.G. Panchayat Raj Adhiniyam, 1993 (In short ‘the Act of 1993’) before the Collector and the proceeding is pending before the Deputy Collector since 2020. As per his instruction till date application submitted by petitioner is not decided. It is the contention of learned counsel for petitioner that a direction be

issued to the Deputy Collector, before whom the proceeding under Section 36 (3) is pending since last about more than two and half years for deciding the application expeditiously within specified time.

Learned State counsel submits that in view of limited prayer made by learned counsel for petitioner, he is having no objection.

Considering the submission of learned counsel for petitioner this petition is disposed off with a direction to the authority before whom the proceedings of case No.2020/2060/00025/A-89/23/ 2020-21 under Section 36 (3) of the Act of 1993 to decide the same expeditiously preferably within a period of two months from the date of receipt of order passed by this Court if not already decided.
