1986 sold 0.91 acre land out of land bearing survey No.1004/2 through a registered sale deed to someone else and though there was an agreement between the parties to execute a sale deed in favour of the defendant No. 1, when defendant No. 1 failed to execute the sale deed, plaintiff, namely, Krishna filed a civil suit for a direction that defendant No. 1 may be directed to execute the sale deed in pursuance of the compromise decree passed by the Lok Adalat. He filed a civil suit for compliance with the earlier compromise decree. The defendant filed the written statement and took a plea that due to a mistake, he entered into a compromise and he has not received consideration and there was no agreement to execute the sale deed. It is further stated in the written statement that possession of the suit property was never handed over to the plaintiff. The learned trial Court framed issues and decided all of them in favour of the plaintiff and against defendant No. 1. The learned trial Court held that the plaintiff is entitled to get the sale deed registered in his favour; defendant No. 1 has already received consideration of Rs. 2800/- and there was an agreement between the parties dated 13.03.1994, thus, the learned trial Court decreed the suit. An appeal was preferred by defendant No. 1 and the same was dismissed by the learned First Appellate Court affirming the findings recorded by the learned trial court.
