This fourth bail application under Section 439 of the Cr.P.C. has been filed by the accused/applicant, who has been arrested on 12.04.2020 in connection with Crime No.208/2020 registered at Police Station City Kotwali, Surguja for the offence under Section 120-B of the IPC.

2. At the outset, learned counsel for the applicant submits that as the trial is already on progress therefore, he does not wish to press this application and seeks permission of this Court to withdraw the same.

3. On due consideration, permission granted.

¶15

4 . Accordingly, this application is dismissed as withdrawn .

5. However, considering the facts and circumstances of the case, the State agency is directed to ensure the presence of the prosecution witnesses on the date of recording of evidence before the trial Court. Learned State counsel shall also inform the concerned Superintendent of Police to take appropriate steps in this regard.

Counsel for the defence is also expected to cooperate with the trial.

6. This Court hopes and trusts that the trial Court shall make earnest endeavour to conclude the trial expeditiously in spirit of
