the applicant and home buyers, in which there was a stipulation that after paying full amount of sale consideration of the land including the house, which is about 34 lakhs, the land is to be registered in favour of them, but neither the complainant nor other home buyers have paid the full sale consideration, thereby the said agreement was not fulfilled by the complainant and other home buyers. It is further submitted that the applicant has also executed agreement with various land owners to purchase their land and this fact is known to all the home buyers, hence, there is no act of cheating. It is further stated that on being demand made by the complainant and other home buyers, the applicant has returned some of the amount to them and he is still ready to return their amount, but it can be possible only when he come out from the custody. He would further submit that the dispute pertains to civil nature, out of four cases of similar nature registered against the applicant, he has been granted bail in three cases vide orders dated MCRC No.2089/2023, MCRC No.2201/2023 and MCRCA No.797/2022 passed on 14.6.2023, 06.5.2023 and 08.9.2022 respectively by the Coordinate Bench, hence, the applicant may be enlarged on bail in this case also.
