This is the First Bail Application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested on 31.12.2022 in connection with Crime No.82/2010 registered at Police Station- Rajim District Gariyaband C.G. for the offence punishable under Sections 420, 409, 120(B), 294, 506/34 of IPC.

As per the prosecution case, the complainant namely Manoj Sahu has lodged FIR at police Station Rajim District Gariyaband alleging that on 07.03.2010 the main accused Faguram Sahu along with other co-accused has allured the general public to deposit money in G.J.A. Investment & Kulchuri Investment Company and promised to

double the amount and thereafter closed the office and fled away, thereby the offence has been committed.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated. He further submits that the applicant has neither received any money nor given any assurance for doubling the same. He further submits that the applicant was not even the employee of the company and he is in jail since 31.12.2022, therefore, he may be enlarged on bail.

Per contra, learned State counsel opposes the prayer for grant of bail and submits that in the supplementary statement recorded during investigation name of present applicant has been mentioned, therefore, he may not be enlarged on bail.

Having considered the facts and circumstances of the case and particularly considering the role attributed against the present applicant and further considering the period of pre trial detention as trial may take time, I am inclined to release the applicant on bail.

It is directed that the applicant shall be released on bail on furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
