The applicants have preferred this first bail application under Section 439 of the Cr.P.C. for grant of regular bail, as they are arrested in connection with Crime No.126/2022, registered at Police Station – Rajpur, District – Balrampur Ramanujganj (C.G.) for the offence punishable under Section 420 r/w Section 34 of the Indian Penal Code and Section 66(D) of the Information Technology Act.

Prosecution story, in brief, on 17-11-2021, the applicants withdraw Rs.67,780/- from the account of complainant and his

family members by playing online fraud through mobile.

Learned counsel for the applicants would submit that the applicants are innocent, they have been falsely implicated in the instant case. He further submits earlier in similar nature of case, both the applicants have granted bail in MCRC No.323/2023 on 15-03-2023. They are in jail since 16-12-2022, charge sheet has been filed, hence, they may be enlarged on bail.

Learned counsel for the State would oppose the bail application filed by both the applicants.

Considered the submissions and perused the case diary.

Considering the facts and circumstances of the case, nature and gravity of offence, particularly considering their period of detention and charge sheet has already been filed, I feel inclined to enlarge the applicants on bail.

Accordingly, the present bail application is allowed. It is directed that if each of them furnishes one local sureties for a sum of Rs.50,000/- along with one personal bond in the like sum to the satisfaction of the trial Court concerned for their appearance before the concerned Court as and when directed by the said Court, they be released on bail.
