no fresh notice was issued and it was only on the basis of communication the ex parte proceeding were drawn on a subsequent date for which no notice was issued. The reasons assigned by the respondent appears to be reasonable and justified as she is resident of Jharkhand. The request made that in case the expenses of travel and stay is paid by the husband she would be able to attend the Court. Incidentally, the ex parte proceeding was not on 15.09.2021 but on subsequent date of 20.10.2021. Therefore, we are of the view that sufficient reasons have been assigned by the appellant/ wife for non appearance before the Family Court, Jashpur and the trial court appears to have been failed to take note that actual date though was fixed as 15.09.2021 but nothing happened on that date but fresh notice was issued but no fresh summons were issued. Accordingly, we deem it proper to set aside the judgment and decree dated 22.07.2022 of learned Family Court, Jashpur and direct the parties to appear before the Family court, Jashpur on 27th July, 2023.
