| The CRMP No.968/2018 has been preferred against the order dated 20.04.2018 passed by the learned Judicial Magistrate First Class, Bilaspur, Dist: Bilaspur (C.G.) in Criminal Case No.901/2014. Another CRMP No.1038/2018 is preferred against the order dated 20-04-2018, passed by the learned Judicial Magistrate First Class, Bilaspur, Dist: Bilaspur (C.G.) in Criminal Case No.907/2014, whereby the complaint preferred by the petitioner in both the petitions under Section 138 of the Negotiable Instrument Act is rejected. Heard on application for Special Leave to file appeal under Section 378(4) of the Cr.P.C. in both the petitions. On due consideration, application for Special Leave to file appeal under Section 378(4) of the Cr.P.C. in both the petitions is allowed. Accordingly, the present petitions are disposed of. The Registry is directed to convert the CRMP Nos.968/2018 and 1038/2018 into the Acquittal appeals. On payment of process fee as per rules, issue notice to the respondent/s in both petitions. List the case in the week commencing from 22-01-2024. SD/- |
