Perused the request letter dated 16.06.2023 received from the Court of Principal Magistrate, Juvenile Justice Board, Mana Camp, Raipur (C.G.) wherein, it has been reported that earlier vide order dated 13.04.2023 passed by this Court in Criminal Appeal No.474/2002 was allowed and the matter was remitted to the Juvenile Justice Board, District Raipur to exercise its power under Sections 15 and 18 of the Juvenile Justice Act, 2015. It is further reported that the said case is a

criminal case arising from the area Police Station- Rajim, District Gariaband and all criminal cases related to children in conflicting with law arising from Rajim police station area are presented before the Juvenile Justice Board, Gariaband and the investigation of the related cases is done by the Juvenile Justice Board, Gariaband, therefore, it is prayed that the direction may be given to the concerned Board to decide the said matter.

On due consideration, the Juvenile Justice Board, District Gariaband (C.G.) is granted further ten weeks' time to dispose of the matter from the date of receipt of this order.

Further order dated 13.04.2023 passed by this Court in Criminal Appeal No.474 of 2002, Paragraph No.11 shall now be read as:

"11.In view of the contentions of Learned Counsel appearing for the parties and for the foregoing reasons, I hold that the Appellants are entitled to get benefit of juvenility. Accordingly, I allow the instant appeal and remit the matter to the Juvenile Justice Board, District G ariaband to exercise its power under Sections 15 and 18 of the Act of 2015 for conducting an inquiry and dispose of the matter within a period of 10 weeks' from the date of receipt of this order. The Board shall exercise its power within the stipulated period and shall pass an appropriate order after conducting an inquiry."

The present CRMP is accordingly disposed of.

A copy of this order be communicated to the concerned Board/Court forthwith for due compliance.
