According to the case of prosecution on 20.04.2016, on the basis of information received from an informant, SubInspector Pramod Amaltash and other officials of Police Station Audhi reached in between village Palatodke and Metatodke, the Appellants and other Maoists have unlawfully assembled with intention to kill the police party and fired them. Both the parties were fired each other, thereafter the Maoists have fled away from the spot. However, the Appellants herein caught hold by the police party. From their possession, guns, tiffen bomb, one piece binocular, contempnor bomb, white and red color electric wires, 03 pieces detonator, one plastic double detonator, 03 piece silver bhagona, blank cartridge etc. were seized. Statements of witnesses were recorded under Section 161 of Cr.P.C. After completion of investigation and other formalities, chargesheet was filed by the Police. Trial Court framed the charges against the Appellants. To robe the Appellants in the crime-inquestion, the prosecution has examined as many as 15 witnesses.
