2. In this case, at the time of incident, age of the prosecutrix (PW6) was about 15 years. As per the case of prosecution, the prosecutrix (PW6) and her brother (PW8) both were studying in class 9th & 10th at Higher Secondary School, Jori and their parents resided at village Devsara. On 10.12.2015, after closing school, when prosecutrix and her brother were returning, on way, the Appellant met them and caught hand of the prosecutrix and dragged her to jungle where he kept her for 5 days and committed forcible sexual intercourse with her. When the incident was informed by brother of the prosecutrix to his father, then the matter was reported by father of the prosecutrix vide Ex.P5. On the basis of which, unnumbered FIR under Section 363 & 366 of the IPC has been registered. On 18.12.2015, the prosecutrix was recovered vide recovery memo Ex.P11. On the basis of unnumbered FIR, numbered FIR (Ex.P16) has been registered. The prosecutrix was medically examined by Dr. Manju Ekka (PW2), her medical examination report is Ex.p2. Statement of the prosecutrix and other witnesses were recorded under Section 161 of Cr.P.C. After completion of investigation, charge-sheet was filed by the Police. Trial Court framed the charges against the Appellant. To robe the Appellant in the crime-in-question, the prosecution has examined as many as 13 witnesses. In statement of the Appellant recorded under Section 313 of Cr.P.C, he pleaded innocence and false implication. However, no defence witness was examined by the Appellant.
