This petition has been filed praying for initiation of the contempt proceedings for non-compliance of the order dated 01.04.2022 passed by the Co-ordinate Bench of this Court in WPS No.2183 of 2022. By virtue of the said order, this Court after considering the grievance of the Petitioner as raised in

the said petition has observed at paragraphs 3 and 4 as under :-

“ 3 . Given the said facts and circumstances of the case,

the respondents No. 1 to 4 are immediately directed to process the claim of the petitioner for the purpose of considering his date of absorption to be 01.07.2018 instead of 01.07.2019.

4 . Let the respondents No.1 to 4 take an appropriate decision after due consideration of the service records of the petitioner and also the circulars of the State Government and the judicial pronouncement passed by this Court in a series of petitions of similar nature at the earliest preferably within a period of 90 days from the date of receipt of copy of this order.”

It appears that in pursuance to the aforesaid direction, the case of the Petitioner has been considered by the concerned Respondent-authority and vide order dated 13.07.2023 (Annexure R/4), the same has been rejected.

Since, the claim of the Petitioner has been considered and decided by the concerned Respondent-authority, vide aforesaid order dated 13.07.2023, I am, therefore, not inclined to initiate the contempt proceedings, as claimed by the Petitioner herein.

The petition is accordingly dismissed.
