secret information that two persons are transporting contraband article ganja in vehicle Tata Safari bearing registration No. MH-04-AA-7193, who were coming from Kukanar. Thereafter, after completing necessary formalities, in the night intervening 12-13/02/2005, the said vehicle was intercepted near Forest barrier, Main Road, in which the accused/respondents were present and accused/respondent No.2-Umesh was driving the vehicle. The said vehicle was searched in which 8 bags (233.400 kilogram) of contraband article ganja was found. On being asked about the valid document for transportation of ganja, no document was produced. Thereafter, the accused/respondents were served a notice under Section 50 of the N.D.P.S. Act vide Ex.P/4, whereupon the accused/ respondents have given their consent to be searched by PW/4 in presence of Gazetted Officer. During search of the vehicle, 8 bags containing contraband ganja was found and the same was recovered from the vehicle. The same was identified to be ganja vide Ex.P./8. After recovery of the ganja, the same was weighed and physically verified vide Ex.P/10. Contraband was homogenized and total quantity of ganja, after its weighment, was found to be 233.400 kilograms. Samples of 50 grams each were taken out from all bags, they were duly sealed and after completion of the exercise, the accused was arrested vide Ex.P/15 and P/16. After returning to Police Station, contraband ganja and its samples were deposited in Malkhana and entry of the same was done in the register. F.I.R. under Sections 8 and 20 (b) of the Act was registered vide Ex.P/26. After completion of investigation, charge sheet was filed under Section 20 (b) (ii) (C) of the Act of 1985.
