For the raid proceeding, hamrah staff, lady constable and witnesses reached the spot and gave notice to the accused under Section 50 of NDPS Act vide Ex.-P-8 informed him about his valuable rights and told him that he could get his search done by any Magistrate or Gazetted Officer. Due to the accused not being educated, with the help of witness Santosh Gautam, after giving his written consent regarding the search, consent panchnama vide Ex.P-9 was prepared. The staff were searched by the accused, in which no objectionable articles were found, search panchnama vide Exs.-P-5 and P-10 were prepared. The search of the accused was done by Lady Constable Kumari Sarita Maravi, in which a substance smelling like ganja was found in four polythene bags inside a hand bag kept with the accused, each weighing 1 kg. Search panchnama was prepared vide Ex.-P-6. Identification panchnama was prepared vide Ex.-P-11. By mixing the recovered ganja, mixing panchnama was prepared vide Ex.-P-12. On weighing the seized ganja, it was found to be 9.070 kg including the sack. Weighing Panchnama was prepared vide Ex.-P-14. Spot map was prepared vide Ex.-P-17. After returning to the police station, the FIR was registered against the accused vide Ex.-P-35. The seized ganja was kept in the Malkhana of the police station for safety. The accused was arrested in front of the witnesses vide Ex.-P-18. The seized sample was sent for FSL to the Forensic Science laboratory, Raipur vide Ex.-P-24, thereafter a report was received and the said substance was found to be ganja. After due investigation, charge sheet was filed under Section 20(B) of the NDPS Act against the applicant.
