In this writ petition filed by the petitioner, who is father of deceased- Ku. Pratima Manjhi, is seeking a direction for re-investigation by an independent authority into the death case of her daughter registered vide Murg No.60/13.

The respondent-State has filed return in this case, wherein in Para-06 to 08 it has been stated as under:

“6. That, on the basis said autopsy reports, inquest and scene of occurrence, the Investigating Officer, i.e. Respondent No.04 registered an offence under Section 302 of Indian Penal Code in Crime No.213/13 against the deceased Ku. Pratima Manjhi @ Chunmun for murder of Dr. Rakesh Manjhi on 19.07.2013 at 23:00 hours and thereafter, taking into consideration that Dr. Rakesh Manjhi already died, she committed suicide. Vide Annexure P/1 the present petitioner was sent F.R. of Mug No.60/13.

Therefore, after fair and impartial investigation it was found that after committing murder of the deceased Dr. Rakesh Manjhi she committed suicide by hanging herself and nobody else is responsible for the said offence.

In view of the above submission, it is respectfully submitted that the investigation was done strictly in accordance with law. The investigation is at verge of completion and a final report in connection with Merg. No.60/13 would be filed before the competent court of jurisdiction at the earliest.”

Since return has been filed stating that necessary closure/final report will be filed before jurisdictional criminal court at the earliest, this writ petition is disposed of with the direction to the respondent-State that said closure/final report shall be filed within 30 days from today before the jurisdictional criminal court, in which said jurisdictional criminal court shall grant opportunity to the petitioner herein to file his protest application, which shall be considered and decided in accordance with law expeditiously. Further, depending upon the outcome of said protest application, the petitioner will be at liberty to proceed further in accordance with law.
