This is the Second Bail Application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested on 15.11.2019 in connection with Crime No. 1106/2019 registered at Police Station Supela, District Durg C.G. for the offence punishable under Section 307 of IPC and r/w Section 25 and 27 of the Arms Act, 1959.

As per the prosecution story a dispute arose on the issue of custody of children whereby the applicant assaulted his wife namely Prerna wherein her left hand was amputated.

Learned counsel for the applicants submits that the applicant is suffering with some mental disease, therefore the present applicant may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail.

Heard learned counsel for the parties and perused the records.

Perusal of the records shows that on the basis of such submission made that applicant is suffering with some mental disease the applicant was examined at the different hospitals and even he was admitted in the Mental Hospital Sendri, Bilaspur from 20.03.2021 to 25.03.2021 during such stay he was examined and it was found that he is suffering from alcohol dependency syndrome with C.P.S. (Complex Partial Seizer). Thereafter, he has been referred for further treatment and has been sent to District hospital Durg thereafter he has been transferred to Central Jail, Raipur for better treatment. Considering the report of the Medical Officer Central Jail, Raipur and as the main cause is shown to be alcohol dependency syndrome with C.P.S. (Complex Partial Seizer) for which the treatment is provided to the applicant and further taking into the gravity of allegations, I am not inclined to grant bail to the applicant.

Accordingly, the bail application is rejected.
