The applicant has moved this application under Section 439 of the Code of Criminal Procedure for grant of regular bail as he is in custody since 07.01.2022 in connection with Crime No.523/2021 registered at Police Station- D.D. Nagar, Raipur, District- Raipur (C.G.) for the offence punishable under Section 420, 34 of IPC.

As per the prosecution case, complainant Uday Ravley has lodged the FIR with the allegation that on 10.08.2020, he received phone calls by which the caller informed him that his policies of LIC and HDFC have

been conceled and the caller is who dealing with the same can help and then, on being induced by the caller, the complainant deposited various amounts in various bank accounts provided by caller in the name of security/tax etc. He made a deposit of total amount of Rs.39,13,364/-. When the complainant came to know about the fraud, he lodged the FIR against the applicant. Thereafter, offence has been registered against the present applicant.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the crime in question. He further submits that on the basis of merely suspicion, applicant has been roped in the false case and he is in jail since 07.01.2022, and, therefore, he may be released on bail.

Per contra, State counsel opposes the bail application and submits that sufÏcient documents related to transactions done by the applicant, have been seized by the police.

Learned counsel for the objector vehemently opposes the bail application of the applicant and submits that there is direct allegation against the applicant and he further submits that the bail application of the coaccused has been rejected by co-ordinate bench of this Court. Therefore, no case is made out to release the applicant on bail.

I have heard learned counsel for the parties and perused the record.

Considering the submissions made by the parties, totality of the facts and circumstances of the case, in particular the nature of crime, at this stage, I am not inclined to release him on bail.

Accordingly, his application filed under Section 439 of the Code of Criminal Procedure is rejected.
