due to the practice of exorcism by the deceased – Chhattar Sai and also the statement that was made by the appellant at the time he has inflicted injuries has relevance as he said that “today I have got the opportunity” that means something must have been going on, on the mind of the appellant prior to the occurrence of this incident and finding the opportunity, he executed his plan and killed the deceased. The number of injuries that were found on the neck and head of the deceased, which have been reported vide (Ex.P.-11) by Dr. A.K. Sharma (P.W.-4) is itself suggestive that the injuries were inflicted with intention to cause death only. There is no evidence present to suggest that there had been any sudden provocation given to the appellant by the deceased or any other person or that there had been any sudden fight between the appellant with the deceased or any other person. Therefore, this case is neither under exception (1) or exception (4) of Section 300 and it is not a case to be under exception 2, 3 and 5 of Section 300. Therefore, it is a clear case of intentional murder of the deceased.
