Upon perusal of service report which was earlier issued to the respondent, it is revealed from the letter dated 13.09.2019 received from Police Station City Kotwali, Mungeli that respondent/accused Vishnu Sahu has died on 07.03.2019. Copy of autopsy certificate issued by Medical Officer, Department of Forensic Medicine & Toxiclogy, Raipur issued on 27.03.2019 is also annexed with the service report.
Learned State counsel raised no objection.
In view of above, this appeal abates and is dismissed as such.
