This is an application filed under Section 438 of the Code of Criminal procedure for grant of anticipatory bail to the applicant, who is apprehending his arrest in connection with Crime No. 1050/2021 registered at Police Station Sarkanda, Bilaspur (CG) for the offence punishable under Sections 452 and 354 IPC and 8 & 12 of Protection of Children from Sexual Offences Act.

Case of the prosecution in brief is that report was lodged by the mother of the victim who is a minor, alleging that made an attempt to outrage her modesty. It is further alleged that on account of which, the victim consumed pesticide to commit suicide.

Contention of the counsel for the applicant is that the applicant has been falsely implicated in the present case. He further submits that the applicant is a government servant. He submits that applicant is in jail since 26.08.21 and the trial will take time for final disposal and therefore he may be released on bail.

On the other hand, learned counsel for the State opposes the bail application. However, counsel for the complainant has no objection if the applicant is granted bail.

Having heard counsel for the parties, considered the totality of the fact, in particular the detention period of the applicant, I am inclined to release him on regular bail. Accordingly, his application filed under Section 439 of the Code of Criminal Procedure is allowed.

It is directed that in the event of the applicant’s furnishing a personal bond in the sum of Rs.25,000/- with one surety for the like sum to the satisfaction of the concerned Court, he shall be released on bail.
