The applicants have preferred these second bail applications under Section 439 of CrPC, as they are arrested in connection with the following crime numbers registration at different police stations of District Raipur (CG) for the offence punishable under Sections 457 & 380 read with Section 34 of the Indian Penal Code :

The first bail applications of the applicants have been dismissed as withdrawn with liberty to file again after seeking information about the other crime numbers registered against the applicants and the release orders, if any.

In all the bail applications the present applicants have been arrested for committing theft of silver ornaments, cash and valuable items. In some of the crime numbers they have been released on bail by coordinate Bench in MCRC Nos.5703/2020 and 6441/2020. Learned counsel for the applicants would submit that in some of the crimes the applicants have been released by the trial Court.

Learned counsels appearing for the State, per contra, would oppose the bail applications.

Considering the entire facts situation of the case, particularly considering the fact that the applicants are in detention since December, 2019 and thus they are in detention for the last 1½ year, as also for the reason that in similar crime numbers the applicants have been released on bail, I am of the opinion that present is a fit case to release the applicants on regular bail.

Accordingly, all the bail applications are allowed and the applicants are directed to be released on bail on each of them executing a personal bond for a sum of Rs.1,00,000/- with two local sureties in the like amount to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given by the said Court.

The applicants shall appear before the concerned Police Station on the first day of every month during pendency of trial.
