On 21.10.2021, this court has directed the petitioner and the respondent No.2 to apear before the Additional Registrar (Judicial) on 08.11.2021 for recording of their statement mentioning that the parties have settled the matter amicably and are residing together as husband and wife.

It has been stated by both the parties that the FIR resigstered at police station Mohan Nagar, district Durg vide crime number 22/2016 in relation to the criminal case No. 3495/2016 be quashed in the light of the

decision of the Supreme Court in the matter of B.S.Joshi & Others V. State of Haryana & Another reported in (2003) 4 SCC 675 wherein it has been held that it is the duty of the Court to encourage genuine settlements of matrimonial disputes even if the offence alleged is a non-compoundable one, the petition is allowed.

Accordingly, FIR dated 12.01.2016 registered at Mohan Nagar, Durg vide Crime No. 22/2016 for the offence punishable under Sections 498-A of the IPC & Cr. Case No. 3495/2016, is hereby quashed.
