At the very outset, Learned Counsel for the parties would seek permission of the Court to withdraw I.A. No. 03/2019 filed u/s 13 (B) of the Hindu Marriage Act, 1955 on 14.02.2019. On due consideration, the application is dismissed as withdrawn.

With our permission learned Counsel for the parties have filed fresh application u/s 13 (B) of the Hindu Marriage Act, 1955. Heard both the counsels on I.A. No. 04/2019 u/s 13 (B) of the Hindu Marriage Act, 1955. We have also heard both the parties who are present today.

The parties were married at Moga (Punjab). However, before filling of the suit they last resided together at Korba (C.G).

Appellant's suit for grant of decree of divorce has been dismissed by the trial Court. Now, the parties have settled their dispute and entered into a settlement by way a Memorandum of Understanding to seek a decree for divorce by mutual consent. The appellant resides at Korba whereas the respondent is a resident of Mumbai. The parties are present today. Since they are living apart for last more than a year and there being no possibility of their joining together to pull on their matrimonial chord, we deem it appropriate to waive the cooling period of six months and allow the application for grant of divorce by mutual consent.

For the facility of reference the terms of settlement between the parties is reproduced hereunder:-

“01. यह ककि कविविवाह किके पश्चवातत् उभयप्ቌ किके मध्य एकिददसरके पर आररोप-्ቚत्यवाररोप किरनके किके किवारण अब उनकिवा दवाम्पत्य जजीविन एकि सवाथ व्यतजीत किरनवा ससभवि नहीሻ हहै । उभयप्ቌ किके ररश्तके-नवातकेदवारोሲ किके दवारवा ककियके गए ्ቚयवास किके बवाविज द उभयप्ቌ किवा एकि सवाथ विहैविवाकहकि जजीविन व्यतजीत किरनवा अससभवि हरो गयवा हहै ।

यह ककि ्ቚथमप्ቌ किके दवारवा कदतजीयप्ቌ किके ममसबई मवायकिके चलके जवानके किके बवाद किरोरबवा किके किमटमम्ब न्यवायवालय मम कविविवाह-कविच्छकेद हकेतम धवारवा 13 (1) कहन्दद कविविवाह अधधकनयम किके तहतत् यवाकचकिवा ्ቚस्तमत किकी गई, धजसमम नरोकटस ्ቚवा्቎ हरोनके किके बवाविज द कदतजीयप्ቌ किके ्ቚकिरण मम उपसस्थत नहीሻ हरोनके किके किवारण एकिप्ቌजीय किवायरविवाहजी किरतके हहए यवाकचकिवा कनरस्त किर दजी गई, धजसकिके कविरू्ሾ ्ቚथमप्ቌ किके दवारवा मवाननजीय छ०ग० उच्च न्यवायवालय, कबलवासपमर किके सम्ቌ अपजील ्ቚस्तमत किकी गई, धजसमम न्यवायवालय किके दवारवा कदतजीयप्ቌ किरो नरोकटस जवारजी ककियवा जवा चमकिवा हहै ।

यह ककि कदतजीयप्ቌ किके दवारवा मवाननजीय छ०ग० उच्च न्यवायवालय, कबलवासपमर किके सम्ቌ कविचवारवाधजीन अपजील ्ቚकिरण मम उपसस्थत हरोकिर कहन्दद कविविवाह अधधकनयम किकी धवारवा 13(बजी) किके

तहतत् परस्पर सहमकत किके आधवार पर कविविवाह-कविघकटत किरवायके जवानके हकेतम यवाकचकिवा ्ቚस्तमत किकी जवाएगजी, धजस पर ्ቚथमप्ቌ किके दवारवा अपनजी सहमकत ्ቚदवान किर उस पर ससयम्ሹ रूप सके हस्तवा्ቌर ककियवा जवाएगवा ।

यह ककि चदचककि उभयप्ቌ कविगत डकेढ़ विररस सके एकिददसरके सके पपृथकि-पपृथकि कनविवास किर रहके हह, उनकिके बजीच दवाम्पत्य-सवाहचयर ससबसध इस अविधध मम स्थवाकपत नहीሻ हहआ हहै तथवा विहैविवाकहकि जजीविन बरकिरवार रखनके हकेतम सवारके ्ቚयवास कविफल हरो चमकिके हह, इसधलयके उभयप्ቌ किके दवारवा न्यवायवालय सके कनयमवानमसवार परस्पर सहमकत किके आधवार पर कविविवाह-कविच्छकेद किकी कडककी ्ቚवा्቎ किरनके हकेतम स्वितस्ቔ सहमकत सके कनणरय धलयवा गयवा हहै ।

यह ककि कदतजीयप्ቌ किके आधधपत्य किके समस्त विसअवाभदरण, धजसमम हजीरके किवा हवार वि किवान मम पहनके जवानके विवालवा बवालजी/इयरररसग 01 सकेट, सरोनके किकी बवालजी/इयरररसग 01 सकेट, सरोनके किवा हवार वि किवान मम पहनके जवानके विवालवा बवालजी/इयरररसग 01 सकेट, सरोनके किकी किवान मम पहनके जवानके विवालजी स्टड 01 सकेट, कदतजीयप्ቌ किके दवारवा कविविवाह पर उपहवार स्विरूप ्ቚथमप्ቌ किरो दजी गई सगवाई किकी हजीरके किकी असगदठजी, सरोनके किकी चकेन, सरोनके किकी असगदठजी 01 नग तथवा इसकिके अकतरर्ሹ समस्त बनवाविटजी (आकटरकफकशियल) आभदरण, कदतजीयप्ቌ किके पहैरोሲ मम पहननके विवालके समस्त जदतके-चप्पल तथवा समस्त विस धजसमम सलविवार-सदट, जीሻस-टटॉप, एविस सवाकडयवास आकद ससम्मधलत हहै तथवा इसकिके अलवाविवा कदतजीयप्ቌ किके बहैग वि सदटकिकेसकेज किरो ्ቚथमप्ቌ किके दवारवा उसके विवापस किर कदयवा गयवा हहै ।

यह ककि ्ቚथमप्ቌ किके दवारवा कदतजीयप्ቌ किरो आजजीविन भरण-परोरण रवाकशि किके रूप मम 15,00,000/- (पन ् ह लवाख) रूपए कदयके जवानके किवा ्ቚस्तवावि ककियवा गयवा हहै, धजसके कदतजीयप्ቌ किके दवारवा सहशिर स्विजीकिवार किर धलयवा गयवा हहै । उ्ሹ रवाकशि मम सके 10,00,000/- (दस लवाख) रूपए किकी रवाकशि इस इकिरवारनवामवा किके कनष्पवादवान किके समय कदतजीयप्ቌ किके नवाम सके अथवातत्र हरकिमल्ቚजीत किकौर किके नवाम सके कडमवाण्ड डडवाफ्ट कमवासकि949134 कदनवासककित-22/01/2019 किके मवाध्यम सके भमगतवान किर कदयवा गयवा हहै, उ्ሹ कडमवाण्ड डडवाफ्ट भवारतजीय स्टकेट बहकि, शिवाखवा-किरोरबवा किके दवारवा जवारजी ककियवा गयवा हहै, जरो भवारतजीय स्टकेट बहकि किकी नविजी म म बई शिवाखवा मम भमगतवान यरोग्य हहै, धजसके

कदतजीयप्ቌ किके दवारवा ्ቚ वा्቎ किर धलयवा गयवा हहै । शिकेर 5,00,000/- (पवासच लवाख) रूपए किरो ्ቚथमप्ቌ किके दवारवा कदतजीयप्ቌ किरो मवाननजीय छ०ग० उच्च न्यवायवालय, कबलवासपमर किके सम्ቌ उपयमर्ሹ धवारवा 13 (बजी) कहन्दद कविविवाह अधधकनयम किके तहतत् यवाकचकिवा ्ቚस्तमत किरनके किके बवाद कविविवाह-कविच्छकेद किकी कडककी्ቚ दवान किरनके किके तत्किवाल बवाद भमगतवान किर कदयवा जवाएगवा ।

यह ककि ्ቚथमप्ቌ सके कदतजीयप्ቌ किके दवारवा उ्ሹ आजजीविन भरण-परोरण रवाकशि ्ቚवा्቎ हरोनके किके पश्चवातत् ककिसजी ्ቚकिवार सके अन्य ककिसजी रवाकशि किके ससबसध मम अथविवा आविवासजीय मकिवान आकद अथविवा अन्य ककिसजी ्ቚकिवार किकी धनरवाकशि किवा भकविष्य मम दवाविवा नहीሻ ककियवा जवाएगवा ।

यह ककि कदतजीयप्ቌ किके दवारवा ्ቚथमप्ቌ किके कविरू्ሾ म म बई नगर अथविवा अन्य ककिसजी नगर मम सस्थत न्यवायवालय मम किरोई घरकेलद कह स वा अथविवा भरण-परोरण ्ቚवा्቎ किरनके हकेतम ्ቚकिरण्ቚ स्तमत ककियवा गयवा हरोगवा, तरो उसके तत्किवाल समवा्቎ किरवा धलयवा जवाएगवा तथवा उभयप्ቌ कविविवाह-कविच्छकेद किके पश्चवातत् अपनवा कविविवाह अन्य व्यक्ሹ किके सवाथ किरनके हकेतम स्वितस्ቔ होሲगके ।

यह ककिस इस परस्पर सहमकत सके कविविवाह-कविच्छकेद हकेतम कनष्पवाकदत इकिरवारनवामवा किके कनष्पवादन किके पश्चवातत् उभयप्ቌ किके दवारवा ककिसजी भजी न्यवायवालय मम एकि-ददसरके किके कविरू्ሾ भकविष्य मम किरोई दवाविवा-्ቚकतदवाविवा नहीሻ ककियवा जवाएगवा ।"

Respondent Harkamalpreet Kaur @ Nancy Johal would state that as she has already received the amount of Rs. 15 lac vide two separate TDRs for Rs. 10 lac and Rs. 5 lac respectively. Both the parties would state that they shall abide by all the terms and conditions mentioned in the Memorandum of Understanding.

In view of the above, prayer for grant of decree of divorce by mutual consent is allowed. A decree of divorce by mutual consent be prepared in terms of settlement contained in para 1 to 9 of the MoU dated 11.01.2019.

Appeal stands disposed of in the above stated terms. No order as to cost.

The original Memorandum of Understanding filed along with the application u/s 13 (B) shall be returned to appellant Amanpreet Singh Ghanjal after retaining xerox copy thereof.
