On due consideration, IA No.1/2019, application for condonation of delay in filing the application for leave to appeal, is allowed and delay of 19 days in filing the application is condoned.

The Trial Court has acquitted the accused from charge under Section 304-B/34 of IPC. Marriage between the deceased and

Rakesh Soni had taken place about 3 months back from the date of incident. There is evidence in the nature of dying declaration and case diary statement of the deceased coupled with statement of her mother showing demand of money and creating pressure on the parents of the deceased for giving the property.

Considering the nature of evidence, we are inclined to grant leave to appeal. Accordingly, prayer for leave to appeal is allowed. The CRMP is disposed of.

Let regular acquittal appeal be registered and notice thereof be issued to the respondents.
