This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested on 12.02.2018 in connection with Crime No. 17/2018, registered at Police Station – Basantpur, District – Balrampur - Ramanujganj (C.G.), for the offence punishable under Sections 419, 468, 469, 471/34 of Indian Penal Code.

Case of the prosecution is that complainant Alekh Sahu lodged FIR alleging that the applicant inconnivance with other co-accused has prepared forged document in which the coaccused impersonating as BTS (Government Officer). It is further alleged that the applicant has called the complainant and threatened him to take back the case.

Learned counsel for the applicant submits that the applicant has been falsely implicated in this case. After completion of investigation charge-sheet has been filed and as per chargesheet the applicant does not have any role and also he has no any criminal antecedent. It is further submits that the coaccused Lalji Singh has been granted bail by this Hon'ble Court in MCRC No. 2743/2018 on 30.05.2018 therefore, he has prayed that the applicant may be enlarged on bail.

Learned State counsel opposes the prayer for grant of bail.

Heard counsel for the party and perused the case diary.

Considering the submissions and the contents of the case diary and looking to the fact that the co-accused has already been granted bail by this Hon'ble Court on 30.05.2018, this Court is of the considered opinion that the applicant should be enlarged on bail in the present case.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is allowed.

It is directed that the applicant shall be released on bail on his furnishing a personal bond for a sum of Rs. 25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed.
