Heard on application (MCC) for restoration of FA (M)( No. 12/2009.
Though the prayer is opposed by the other side, taking into consideration the cause shown in the application, I am satisfied with the ground as mentioned for his non-appearance when the case was called on for hearing.
Accordingly, the application is allowed. Order dated 17.09.2018 which was dismissed for want of prosecution is hereby recalled and the F.A.(M) No. 12/2009 is restored to its original number subject to applicant depositing cost of Rs. 1,000/- with the High Court Legal Aid Committee.
