2 years. Further case of the prosecution is that accused/appellant jumped into canal along with her two daughters as a result of which, her two daughters died. The accused/appenant somehow survived and went to her brother‘s house Gupteshwar (PW/3), from the house of Gupteshwar an information was sent to the Dhananjay Gupta (PW/7), husband of appellant and when he met the appellant, she informed him that on 14.09.2005 she boarded the train to go to Bihar and when she gotdd‘vfnfromthetrainto buy bread, the train left the station and she could not board in it. On 14.09.2005 missing report was lodged by £ Dhananjay (PW/71w which basis entries were made in the Rojnamcha Sanha vide ExP/lO—C. On 13.09.2005 dead body of Ankita was found in the canal near Baradwar, whereas dead body of another daughter Annapurna was found on 14.092005 in the canal ._ ~ near village Saragbundiya. Inquests on the dead bodies ofAnkita and Annapurna were conducted vide Ex.P/19 and P/l4 & bodies were sent for postmortem to Primary Heatth Center, Kurda and Saragbundiya vide EXP/15 respectively Where Dr. J. Singh (PW/9) conducted postmortemonthebodyof deceased Ankita vide Ex.P/8, whereas Dr. DR. Raj (PW/4) conducted postmortem on the body of deceased Annapurna vide EXP/3. As per postmortem reports, the cause of death of deceased was asphyxia due to drowning. 03. On completion of investigation, charge sheet for the offence punishable under Section 302 IPC was filed against the accused/appellant, however, while framing the charge the trial Court has framed charge against the accused /appellant under Sections 309 and 302 IPC (on two counts).
