The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.380/2016 registered in Police Station Sarkanda, District Bilaspur (CG) for offence punishable under sections 457, 380, 411/34 of Indian Penal Code.

As per the prosecution case, a theft took place in the grocery shop of Vijay Kumar and different grocery items were stolen. Subsequently, the applicant was arrested and from his possession few of the articles were seized.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case and the article seized were general articles which are available in the market, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail.

Perused the case diary. From the applicant one packet mustard oil, one packet fortune oil, six soaps and three rin soaps were seized. Taking into facts and circumstances and nature of recovery and also for the fact that charge sheet has been filed, this court is inclined to release the

applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
