The petitioners are the alleged shareholders of respondent No.S/Society and according to them, term of the Society has expired on 7.7.2013 but till date no steps have been taken for conducting fresh election of the Society.

While referring to the letter dated 17.7.2013 (Annexure P/5), learned State counsel submits that after the amendment, election of the Society would be conducted by the State Election Commission and therefore, the petitioners may approach it.

At this stage, learned counsel for the petitioners wants to withdraw this petition with liberty to approach the State Election Commission by way of filing application/representation for the purpose of conducting election of the Society. He further submits that the State Election Commission may be directed to consider and decide such application of the petitioners expeditiously and hold the election at the earliest. 04. In view of the above, the petition is disposed of with the aforesaid liberty to the petitioners. In the eventuality of filing any such application/representation by the petitioners before the State Election Commission, the same would be decided by it strictly in accordance with law.

It is made clgar that this Court has not expressed any opinion on the merits of the case and it is for the State Election Commission to decide the application/representation ofthe petitioners on its own merits.
