By this petition, the petitioner seeks to invoke supervisory jurisdiction under Article 227 oF the Constitution of India and has prayed For quashment oF the order-dated 17.10.2003 passed by the 2nd Additional District Judge, Durg in unregistered Rrst appeal (Smt. Kumud Yadav vs. Managing Director, Bhilai Steel Plant, Tah. & Disl:t<.Durg) and others, whereby the First trial Court has dismissed the application for condonation of delay in Filing the appealandalso Firstappeal.

Leamed counsel For the petitioner submits that by dismissing the application Forcondonation oFdelay, firstappellate Court has committed an illegality and has not considered the explanation oFFered by the appellant.

Vide order impugned, first appellate Court has dismissed the applicatipn For condonation of delay.as well as the appeal as time barred, which is appealable, therefore petition under Article 227 of the Constitution of India is not maintainable and dismissed as not maintainable. No order as to costs.
