This is claimant's appeal for enhancement of the compensation awarded by the Second Additional Motor Accident Claims Tribunal, Surajpur, district Surguja (for short 'the Tribunal') vide award dated 08.02.2010, passed in Claim Case No.01/2009. 2) As against the compensation of Rs. 11,52,0007- claimed by the appellant/ claimant, unfortunate major son of deceased Fuleshwar by filing a claim petition under Section 166 ofthe Motor Vehicles Act, for his death in the motor accident on 29.06.2008, the Tribunal awarded a total sum of Rs.1,74,000/as compensation along with interest @ 7.5% per annum from the date of filing of the claim petition till date of actual payment. 3) The Tribunal on a close scrutiny of the entire evidence led before it held that deceased Fuleshwar died on account of the injuries sustained by him in the motor accident on 29.06.2008; the accident occurred due to the negligence of deceased Fuleshwar himself who was driving the Tractor bearing registration No.C.G.15-A/5575 and the driver of the other vehicle Bus bearing registration No.C.G.15-A/4439; the negligence of deceased Fuleshwar and the driver of the other vehicle Bus was to the extent of 50% each; as the above Tractor and Bus, on the date of the accident, were insured with the Oriental Insurance Company
