Leamed counsds appeanmg for fhe pctituDcre further contended that fhe Act 1967, (he Rufes 1976, the Rutes 1977 and tfae Rufes 1979 were adapted by the State of CUhattisgarh aflier creatioa of thc Statc of CUhattisgaA oa 1.11.2000 finm the existing State of Madhya Pradesh pursiiant to the proviskms of fhe M.P. Reotganization Act, 2000. Thus, fhc decision rendered by the FuU Beach of the High Court of Madhya Pradesh at GwaBor would be appUcabte to fhe facts offhe present cases also.

The dcfinition of the^"contingency paid employe^' and *workchai^ed emptoyce" are the saine under fhe pxovisians of fhe Rutes, 1976 and fhat of fhe Rules, 1979. In Rutes, 1979, the 'pennanent emptoyee' was defined in Rute 2 (c) as a workcharged em.ployec who has compteted 15 ycars of servfce on or after 1.1.1974.
