Ld. Counsel for the respondent has filed the reply of the application submitted by the counsel for the appellant for withdrawing of the appeal. Appellant has stated that amicable settlement has been arrived between the parties and he is ready to deposit the settlement amount.
Reply has been filed on behalf of the respondent wherein respondent has vehemently denied the statement made by the appellant stating that the claim of the appellant that both the parties have reached on an amicable resolution of the matter is totally incorrect as there is no such provision under the statute to allow such exercise.
In view of the above application filed by the appellant stands allowed and the appeal filed before this tribunal is dismissed as withdrawn. Respondent is at liberty to recover the amount as per rules.
