File is taken up for consideration of an application filed for restoration of appeal which was dismissed by this tribunal on 30.04.2022 considering the continuous absence of the appellant. Appellant counsel submitted that his previous counsel had not informed the appellant rather she had misinformed the date as 06.05.2025. He further submitted that after being engaged in this matter he came to inspect the case file on 11.08.2025, then he came to know about the dismissal of the appeal. Respondent has not filed the reply to this application filed for restoration of appeal. However, she submitted that appellant is negligent in pursuing the appeal. He does not care to file the rejoinder despite being given ample opportunities.
I have heard the argument. Though, the ground taken by the appellant is not satisfactory because he has not placed any document regarding the noting down of the date as well as appearance on that particular date by nobody. Yet in the interest of justice this application stands allowed subject to payment of cost Rs.10,000/- out of which, Rs.7000/- is payable to the Registrar CGIT and Rs.3000/- is payable to respondent counsel within a week.
With this, appeal is restored to the original position. Counsel is given three weeks time to file rejoinder. Copy of this order is given to both the parties through email. Put up for 01.10.2025 for filing of rejoinder by the appellant.
